PROGENE SUBSCRIPTION PLAN TERMS & CONDITIONS

Program Benefits
Progene Subscribers receive an introductory trial of Progene for only the cost of shipping and handling. Continued subscription beyond the initial 14-day trial period provides the following benefits:

By placing an order, receiving a trial and/or continuing in your Subscription Plan you agree to all the terms of our Subscription Plan below along with any applicable Site and Privacy terms.

You have no obligation to buy anything in the future as long as you call to cancel this Subscription Plan within 17 days after you place your order. If you do not cancel before then, your Subscription Plan will continue and remain in effect until you cancel.

IF YOU CHOOSE TO ORDER A TRIAL, YOU WILL BE ENROLLED IN THIS SUBSCRIPTION PLAN UNLESS YOU CANCEL WITHIN 17 DAYS OF PLACING THIS ORDER.

Beginning in about 18 days after you place your order, you will automatically receive a new 60ct refill of Progene and be charged $59.95 to the payment form on file with free s/h for the shipment. You will then continue to receive refills about every 30 days for as long as you choose to stay in this Subscription Plan. To cancel or reschedule any future shipments in this Subscription Plan, you must call 866-PROGENE [866-776-4363] at least 1 day before the date that your next monthly subscription is set to ship.

Participation Conditions
You must pay electronically to enroll in this program and provide correct, current complete and accurate information on your account (such as any changes in addresses, payment info or payment expiration dates). If there are any changes, you must promptly notify us, including if there is loss or theft of your payment method information. This can be done by calling our customer service department at 866-PROGENE. There is a limit of 1 Progene Subscription per household, person, or credit card. Any trials that exceed this limit will be subject to a subsequent billing for the normal MSRP cost of trial product. Resale of trial product is strictly prohibited. Any individual or entity found to be using this trial program for the purposes of product resale (without proper payment of trial product) shall have committed fraud and subject to the MSRP cost of products received. We reserve the right to accept, refuse or terminate your subscription at any time and at our sole discretion.

Subscription Billing
The monthly cost of product beyond the initial trial period is $59.95 with free s/h. Shipping & Handling (s/h) fees are non-refundable. Product purchases may be eligible for refund as expressly set forth in these Terms. YOU UNDERSTAND YOUR PROGENE SUBSCRIPTION IS A RECURRING CHARGE. YOUR SUBSCRIPTION WILL AUTOMATICALLY RENEW AFTER THE 15 DAY TRIAL PERIOD STARTING FROM THE DATE OF INITIAL PURCHASE AND EVERY 30 DAYS THEREAFTER. UPON RENEWAL, A SUBSCRIPTION SHIPMENT WILL BE AUTOMATICALLY SENT AND THE PAYMENT METHOD YOU HAVE PROVIDED US, AUTOMATICALLY CHARGED. BY PROCEEDING WITH YOUR ORDER AND AGREED SUBSCRIPTION RENEWALS, YOU AUTHORIZE US TO CHARGE TO YOUR CREDIT OR DEBIT CARD (WITHOUT NOTICE TO YOU) AND THAT WE WILL NOT OBTAIN ADDITIONAL AUTHORIZATION FROM YOU FOR EACH RENEWAL. THE RENEWAL WILL INCLUDE APPLICABLE PRODUCT COST AND SHIPPING FEES, UNLESS YOU NOTIFY US AT LEAST 1 BUSINESS DAY BEFORE RENEWAL THAT YOU WANT TO CANCEL YOUR SUBSCRIPTION. YOU AGREE TO NOT HOLD US RESPONSIBLE FOR ANY OVERDRAFT CHARGES OR FEES YOU MAY INCUR FROM THE AUTOMATIC PROCESSING OF ANY SUBSCRIPTION RENEWALS.

Cancellation & Refunds
We offer a 30 Day satisfaction guarantee on all monthly subscriptions. If you are not satisfied with our product for any reason, you can return the product (used or unused packaging) for a full refund of the last subscription amount - refunds are limited to the last renewal. To cancel, call 866-PROGENE [866-776-4363] or notify us via email at CustServ@Progene.com at least 1 day before the date that your next monthly subscription is set to ship. To receive a refund, you must obtain a Return Merchandise Authorization (RMA) number within 30days of the purchase. This must be clearly written on the outside of the package for correct credit to your account. The returns department cannot accept any shipments without an RMA and will return / refuse any such shipment. You will then be responsible for the return shipping.

Ship return packages to our MidWest Distribution facility at 1901 Dalton Av, Cincinnati Ohio 45214. To ensure proof of delivery, we recommend shipping your return with a tracking number and insurance to cover for any loss in transit. We will not be responsible for any lost or delayed shipments.

Upon receipt of your returned product and a valid RMA number, a refund will be issued in approximately 3-5 business days. Please note, depending on the refund method, it can take up to 1 billing cycle for this to post on your account statement. We reserve the right to refund via an alternate method (eg. check).

Agreement Changes
We may in our discretion change these Terms without notice to you. YOUR CONTINUED SUBSCRIPTION AFTER WE CHANGE THESE TERMS CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES. IF YOU DO NOT AGREE TO ANY CHANGES, YOU MUST CANCEL YOUR SUBSCRIPTION.

Termination by Us
We may terminate your subscription at our discretion without notice.

Limitation of Liability
IN NO EVENT WILL WE OR OUR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS OR OTHER REPRESENTATIVES BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY OTHER DAMAGES OF ANY KIND, ARISING OUT OF OR RELATED TO THE PROGENE SUBSCRIPTION PLAN. OUR TOTAL LIABILITY, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, WILL NOT EXCEED THE LAST MONTHLY SUBSCRIPTION FEE YOU PAID. IN ADDITION TO PARTICIPATION IN PROGENE’S SUBSCRIPTION PLAN, YOU HEREBY IRREVOCABLY WAIVE ANY RIGHT YOU MAY HAVE TO JOIN CLAIMS WITH THOSE OF OTHERS IN THE FORM OF A CLASS ACTION OR SIMILAR PROCEDURAL DEVICE. ANY CLAIMS ARISING OUT OF, RELATING TO, OR CONNECTED WITH THIS SITE, PRODUCT, SERVICE OR TERMS OF SERVICE MUST BE ASSERTED INDIVIDUALLY AND NEITHER YOU OR PROGENE HAS THE RIGHT TO ACT AS A CLASS REPRESENTATIVE OR PARTICIPATE AS A MEMBER OF A CLASS OF CLAIMANTS WITH RESPECT TO ANY CLAIM. THESE EXCLUSIONS AND LIMITATIONS OF LIABILITY WILL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW AND WILL SURVIVE CANCELLATION OR TERMINATION OF YOUR SUBSCRIPTION. CERTAIN STATE LAWS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MIGHT HAVE ADDITIONAL RIGHTS.
